Medical Waiver and Release of Liability

PLEASE READ CAREFULLY — THIS IS A LEGAL WAIVER AND RELEASE OF LIABILITY

By registering my child(ren) with the Spruce Grove Barracudas Swim Club, I acknowledge and agree to the following:

1) Parent/Guardian Certification

I certify that I am the parent or legal guardian of the child(ren) named in this registration and that I have full authority to execute this waiver on their behalf.

2) Authorization for Medical Care

I authorize any supervisor, coach, volunteer, or team administrator affiliated with the Spruce Grove Barracudas Swim Club or the Alberta Summer Swim Association to seek and authorize appropriate medical evaluation and treatment for my child(ren) in the event of accident, injury, or illness occurring during, immediately before, or immediately after participation in club or association activities.
I understand and agree that I am responsible for all costs associated with such medical care, including evaluation, treatment, transportation, and related expenses.

3) Acknowledgment of Inherent Risks

I understand that participation in swimming and aquatic activities involves inherent, foreseeable, and unforeseeable risks, which may include, but are not limited to:

• Slips, trips, and falls on wet or uneven surfaces;
• Muscle strains, sprains, overuse injuries, cramps, and fatigue;
• Impact injuries from lane ropes, walls, starting blocks, or other participants;
• Exposure to pool chemicals (e.g., chlorine) and related irritations;
• Breathing difficulties, shallow-water blackout, and water aspiration;
• Drowning and near-drowning events;
• Weather-related risks for outdoor activities (e.g., lightning, heat, cold).

I choose to allow my child(ren) to participate with knowledge and acceptance of these inherent risks.

4) Waiver, Release, and Indemnity (Including Negligence)

In consideration of my child(ren)’s participation in activities associated with the Spruce Grove Barracudas Swim Club and/or the Alberta Summer Swim Association, I hereby waive, release, and forever discharge the club, the association, their directors, officers, employees, coaches, volunteers, contractors, agents, and representatives (collectively, the “Released Parties”) from any and all claims, liabilities, demands, damages, costs, and causes of action arising out of or related to injury, loss, or damage to person or property that may occur during or in connection with participation, including those arising from the ordinary negligence of any Released Party, to the fullest extent permitted by law.
I further agree to indemnify and hold harmless the Released Parties from any and all claims brought by or on behalf of my child(ren) or any third party arising from my child(ren)’s participation, except to the extent prohibited by law.

5) Fitness to Participate and Duty to Disclose

I acknowledge that my child(ren) is/are physically fit to participate in swim team activities. I agree to disclose any medical condition, allergy, medication, or limitation that may affect safe participation and to keep such information current.

6) Assumption of Responsibility for Personal Property

I acknowledge that the Released Parties are not responsible for the loss, theft, or damage of personal belongings brought to any activity, facility, or event.

7) Electronic Consent and Online Execution

By submitting this waiver online:

• I agree that my electronic signature and the act of checking required boxes/initials have the same legal effect as a handwritten signature.
• I confirm that I have had sufficient time to read this waiver, that it was presented clearly, and that I had the opportunity to ask questions before agreeing.

8) Governing Law and Jurisdiction

This agreement shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. I agree that any dispute arising from or related to this agreement or participation shall be brought exclusively in the courts of Alberta.

9) Severability and Entire Agreement

If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force. This agreement constitutes the entire understanding regarding the subject matter and supersedes prior representations concerning liability release for the described activities.

10) Acknowledgment and Agreement

By submitting this form, I acknowledge that I have read and understood the above terms; that I voluntarily agree to them; and that I am waiving certain legal rights, including the right to sue the Released Parties for ordinary negligence.
