Liability Waiver and Assumption of Risk

PLEASE READ CAREFULLY — THIS IS A LEGAL WAIVER AND RELEASE OF LIABILITY

By registering my child(ren) with the Spruce Grove Barracudas Swim Club, I acknowledge and agree to the following:

1) Parent/Guardian Certification

I certify that I am the parent or legal guardian of the child(ren) named in this registration and that I have full authority to execute this waiver on their behalf.

2) Program Scope and Activities

I understand that participation with the Spruce Grove Barracudas Swim Club may include practices, dry-land training, clinics, meetings, social events, swim meets, and travel to and from such activities (collectively, “Activities”), whether conducted at pools, gyms, schools, arenas, outdoor venues, or other locations approved by the Club or the Alberta Summer Swim Association.

3) Acknowledgment of Inherent Risks

I acknowledge that my child(ren)’s participation involves inherent, foreseeable and unforeseeable risks, including but not limited to:

• Aquatic risks: slips and falls on wet surfaces; collisions with lane ropes, walls, starting blocks, or other participants; muscle strains, sprains, cramps, fatigue; shallow-water blackout; water aspiration; drowning or near-drowning; exposure to pool chemicals (e.g., chlorine);
• Training risks: overuse injuries, impact with equipment, weather-related exposure for outdoor sessions;
• Travel risks: motor-vehicle incidents, delays, and hazards associated with transportation to/from Activities;
• Facility risks: uneven surfaces, equipment malfunctions, and conditions beyond the Club’s immediate control.

I choose to allow my child(ren) to participate with knowledge and acceptance of these inherent risks.

4) Release of Liability (Including Ordinary Negligence)

In consideration of my child(ren)’s participation in the Activities, I hereby release and forever discharge the Spruce Grove Barracudas Swim Club, the Alberta Summer Swim Association, and their respective directors, officers, employees, coaches, volunteers, contractors, agents, and representatives (collectively, the “Released Parties”) from any and all claims, demands, actions, damages, losses, or causes of action, whether known or unknown, arising out of or related to injury (including injury resulting in death), illness, or property damage occurring during or in connection with the Activities, including those arising from the ordinary negligence of any Released Party, to the fullest extent permitted by law.

5) Indemnity and Hold Harmless

I agree to indemnify and hold harmless the Released Parties from and against any claim, demand, action, or expense (including legal fees on a solicitor-client basis) brought by or on behalf of my child(ren) or any third party that arises out of or relates to my child(ren)’s participation in the Activities, except to the limited extent prohibited by applicable law.

6) Assumption of Responsibility for Personal Property

I understand that the Released Parties are not responsible for loss, theft, or damage to personal property brought to any Activity, facility, or event.

7) Fitness to Participate and Duty to Disclose

I confirm that my child(ren) is/are physically fit to participate and that I will disclose any medical condition, allergy, medication, or limitation that may affect safe participation and keep such information current.

8) Governing Law and Jurisdiction

This waiver shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute arising out of or related to this waiver or the Activities shall be brought exclusively in the courts of Alberta.

9) Electronic Consent and Online Execution

By submitting this waiver online, I agree that my electronic signature and any required initials/checkbox selections have the same legal effect as a handwritten signature. I confirm that I had sufficient time to read this waiver, that it was presented clearly, and that I could ask questions before agreeing.

10) Severability and Entire Agreement

If any provision is found unenforceable, the remaining provisions shall continue in full force and effect. This waiver constitutes the entire agreement with respect to liability release for the Activities and supersedes prior representations on the subject.

11) Acknowledgment and Agreement

By submitting this form, I acknowledge that I have read and understood the above terms; that I voluntarily agree to them; and that I am waiving certain legal rights, including the right to sue the Released Parties for ordinary negligence.
